General Terms and Conditions of Sale and Use (GTC)

These terms of sale are entered into on the one hand by the company BATICOLAGE, whose registered office is located at Chaussée de Waterloo, 342 / 1060, Saint-Gilles, registered under number BE 0809.645.439, hereinafter called "WOODSOLNETTE SPRL" managing the site www.baticolage.com and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.baticolage.com, hereinafter called "the buyer".

Article 1. Purpose

These terms of sale aim to define the contractual relations between BATICOLAGE and the buyer and the conditions applicable to any purchase made through the website www.baticolage.com. The acquisition of a product through this site implies unconditional acceptance by the buyer of these terms of sale, which the buyer acknowledges having read prior to placing the order. Before any transaction, the buyer declares having full legal capacity, allowing them to commit under these general terms of sale.

The company BATICOLAGE reserves the right to modify these terms of sale at any time, in order to comply with any new regulations or to improve the use of its site. Therefore, the conditions applicable will be those in force on the date of the buyer’s order.

Article 2. Products

The products offered are those listed on the site www.baticolage.com of the company BATICOLAGE, subject to available stock. The company BATICOLAGE reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description listing its main technical characteristics. This sheet reproduces in a non-exhaustive manner the information described on the product packaging. Only the product labelling is binding. The photographs are as faithful as possible but do not bind the Seller in any way.

Article 3. Prices

The prices shown on the product sheets of the online catalogue are prices in Euros (€) all taxes included (ATI), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be passed on to the product prices. The company BATICOLAGE reserves the right to change its prices at any time, it being understood that the price shown in the catalogue on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased according to the total amount of the order.

Article 4. Order and payment methods

Before any order, the buyer must create an account on the site www.baticolage.com. The account creation section is directly accessible from the side menu bar. At each visit, the buyer, if they wish to order or consult their account (order status, profile…), must identify themselves using this information.

Payment method:

- Secure payment by bank card: Payments by bank card on this website are made through the secure payment system Shopify Payment. The information exchanged is thus encrypted with SSL (Secure Socket Layer) before being transmitted. Since this information is unreadable, no one can use it without your knowledge. To increase the security of your banking information, Shopify Payment does not keep it. That is why you will have to provide it to us with each new order.

Confirmation of an order implies acceptance of these terms of sale, acknowledgment of having full knowledge of them, and waiver of relying on one’s own purchase conditions. All data provided and the recorded confirmation will serve as proof of the transaction. If the buyer has an email address and has provided it on their order form, the company BATICOLAGE will send them an email confirming the registration of their order.

Article 5. Retention of title

The company BATICOLAGE retains full ownership of the products sold until full payment of the price, including principal, fees, and taxes.

Article 6. Withdrawal

For any order, and subject to the application of article 11.5, the Client has the right to withdraw without giving any reason, within a period of fourteen days. The withdrawal period expires fourteen days after the day on which the Client, or a third party other than the carrier and designated by the Client, takes physical possession of the Products. The 14-day period starts the day after the conclusion of the contract or the delivery of the Products depending on the type of contract. If this period expires on a Saturday, Sunday, or public holiday, it is extended to the next working day.

If it is a single order covering several products delivered separately, the withdrawal period expires fourteen days after the day on which the Client, or a third party other than the carrier and designated by the Client, takes physical possession of the last product delivered.

No goods ordered from our suppliers (and therefore not stocked by BATICOLAGE) will be taken back or exchanged. The right of withdrawal does not apply to partial deliveries. It is not possible to return only some delivery packages.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Delivery times are given for information only. Claims of delivery errors must be made to BATICOLAGE on the day of delivery or the next working day at the latest. The company BATICOLAGE may provide the buyer with the tracking number of their parcel by email. In the event that the Client is not present on the date and within the time slot indicated by the carrier, BATICOLAGE may re-invoice the Client for the costs incurred with the carrier to deliver the Products to the Client, as well as the costs to resend them to its warehouses. The risks related to transport are borne by the buyer from the moment the items leave the premises of the company BATICOLAGE. The buyer is required to check, in the presence of the postal clerk or the delivery person, the condition of the packaging and its contents upon delivery.

Article 8. Guarantee

All products supplied by the company BATICOLAGE benefit from the legal guarantee provided by articles 1625 and following of the Civil Code. In case of non-conformity of a sold product, it may be returned to the company BATICOLAGE, which will take it back, exchange it, or refund it. All claims, requests for exchange or refund must be made by post to the following address: info@baticolage.com, within fourteen days after delivery.

Article 9. Liability

The company BATICOLAGE, in the distance selling process, is only bound by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service interruption, or other involuntary problems.

Article 10. Intellectual property

All elements of the site www.baticolage.com are and remain the intellectual and exclusive property of the company BATICOLAGE. No one is authorized to reproduce, exploit, or use in any way, even partially, elements of the site whether in the form of photos, logos, visuals, or text.
