Email marketing (if applicable): with your permission, we may send you emails about our shop, new products and other updates.
ARTICLE 2 – WHY WE PROCESS YOUR DATA, AND OUR LEGAL BASIS
In accordance with the GDPR, each processing activity is based on one of the following legal bases:
| Purpose | Legal basis (GDPR, Art. 6) |
|---|---|
| Processing and delivering your order, handling returns/withdrawals and warranty claims | Performance of a contract |
| Responding to customer service requests | Performance of a contract / legitimate interest |
| Invoicing, accounting, fraud prevention | Legal obligation / legitimate interest |
| Sending the newsletter or marketing emails | Consent |
| Basic site analytics and security | Legitimate interest |
| Non-essential cookies (analytics, marketing) | Consent, collected via our cookie banner |
How do we obtain your consent? When you provide personal information to complete a transaction, verify your payment method, place an order, arrange a delivery or return a purchase, we assume you consent to our collecting it and using it for that purpose. If we ask for your personal information for another reason, such as marketing, we will ask for your explicit consent or give you the option to refuse.
How do you withdraw your consent? You can notify us at any time at info@baticolage.com, via the unsubscribe link in every marketing email, or by post to: BATICOLAGE, Chaussée de Waterloo 342, 1060 Saint-Gilles, Brussels, Belgium. Withdrawing consent does not affect the lawfulness of processing already carried out.
ARTICLE 3 – DISCLOSURE
We may disclose your personal information if required by law, if you breach our General Terms of Sale and Use, or to the service providers identified in Articles 4 and 5 below, strictly to the extent necessary for them to perform their services. We do not sell your personal data.
ARTICLE 4 – SHOPIFY
Our shop is hosted on Shopify Inc. This company provides the online e-commerce platform that allows us to sell our products to you.
Your data is stored in Shopify's data storage and databases, and in the general Shopify application. Your data is kept on a secure server protected by a firewall.
Payment: if you pay through a direct payment gateway (Shopify Payments and/or the payment methods shown at checkout, such as Bancontact or iDEAL depending on the destination), your card details are encrypted in accordance with the PCI-DSS standard. Your transaction details are kept only as long as necessary to complete your order; once it is completed, this information is deleted beyond what PCI-DSS processing requires.
For more information, see Shopify's Terms of Service and Privacy Policy.
ARTICLE 5 – THIRD-PARTY SERVICES
In addition to Shopify, we use Klaviyo as our email marketing platform, to send the newsletter and order-related emails to customers who have given their consent, as well as carriers (mainly GLS, and regional carriers depending on the destination), who receive your name, delivery address and phone number to fulfil your order.
In general, the third-party providers we use only collect, use and disclose your information to the extent necessary to perform the services they provide to us. Some, such as payment gateways, have their own privacy policies; we recommend that you read them.
International data transfers: some of our providers (including Shopify and Klaviyo) are based in, or transfer data to, the United States. Where this happens, transfers are made under the EU Standard Contractual Clauses or another safeguard recognised by the GDPR (and, for data subjects in Switzerland, by the Federal Act on Data Protection). You can ask us for more information about these safeguards at info@baticolage.com.
Once you leave our shop's website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Terms of Sale. We are not responsible for the privacy practices of those other sites.
ARTICLE 6 – RETENTION PERIOD
- Order and invoicing data: kept for the statutory accounting/tax retention period (generally 7 years in Belgium).
- Payment transaction details: deleted once the order is completed, as stated in Article 4.
- Marketing/newsletter data: kept until you unsubscribe, or after a period of inactivity, whichever comes first.
- Customer service correspondence: kept for a reasonable period to handle any follow-up requests, then deleted.
ARTICLE 7 – SECURITY
To protect your personal data, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide your card details, they are encrypted using SSL and stored with AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow the requirements of the PCI-DSS standard and additional generally accepted industry standards.
